Disclosures to HMRC
Any voluntary disclosures to HMRC will be categorised as either A) or B) below (there is no in between):
A) Unprompted
A disclosure is unprompted if it is made at a time when the person making it has no reason to believe that HMRC have discovered or are about to discover the inaccuracy, under-assessment, failure to notify, deliberate withholding of information or wrongdoing. Otherwise it is prompted:
B) Prompted
A disclosure is prompted if it does not qualify as “unprompted” [ see A) above ].
Unprompted Disclosures to HMRC – The Advantages
- Substantially reduced chance of being criminally prosecuted.
- Substantially lower penalties.
- Generally, greater time is permitted to finalise the disclosure once HMRC have been notified.
- The management of an unprompted disclosure is less pressurised and less stressful.
